TRADEMARK SEARCHING

Attorney Stacy E. Don advises clients on the selection of trademarks. She works with well-established trademark screening companies to conduct trademark searches. She counsels clients on the results of the search and strategies for protection and use of the mark based on the results of the search. 

FILING TRADEMARK APPLICATIONS

Stacy prepares and files applications with the United States Patent and Trademark Office. She has experience in responding to office actions addressing a number of issues that include likelihood of confusion, descriptiveness, geographic descriptiveness, surname refusals, foreign equivalents, and amendments to descriptions of goods and services. 

She assists clients to protect their marks in other countries, including filing applications under the Madrid Protocol to protect marks abroad and managing foreign trademark counsel for U.S.-based clients who are seeking protection abroad. 

MAINTAINING TRADEMARK REGISTRATIONS

Portfolio management services include providing assistance in maintaining trademark registrations, communicating with the United States Patent and Trademark Office, and drafting and recording trademark assignment agreements. 

PROTECTING AND ENFORCING TRADEMARK RIGHTS

Stacy counsels clients regarding ways to protect their trademark rights. Stacy helps clients enforce their trademark rights. She offers a variety of services, including drafting cease and desist letters, negotiating licensing, consent or concurrent use agreements, and engaging in litigation before the Trademark Trial and Appeal Board or federal courts.

Attorney Stacy E. Don is a civil litigator and appellate advocate. She represents clients in civil litigation and appeals before California's state and federal courts.  

She has represented clients in cases featuring a variety of issues including disputes regarding commercial contracts, statutory construction, constitutional issues, Proposition 65, trademarks, trade secret misappropriation, tortious interference, unfair competition, attorneys’ fees, and regulatory compliance.

Stacy is a trademark and business litigation attorney. Stacy’s practice focuses on trademark counseling and prosecution. Stacy also litigates business disputes in the California state and federal trial and appellate courts.

Stacy teaches trademark law as a lecturer at UC Davis School of Law and USC Gould School of Law.

From 2003 to 2013, Stacy practiced law at the international law firm of Orrick, Herrington and Sutcliffe LLP.

In 2003, Stacy graduated Order of the Coif from UC Davis School of Law. Stacy received her B.A. in Political Science with honors from the University of California, Berkeley.
